The state has informed the High Court that 17-year-old student Hasnatul Islam Faiyaz will not be taken on remand in the case of the murder of a police officer during the quota reform movement in Matuail.
Yesterday, a Dhaka Metropolitan Magistrate’s Court granted a 7-day remand for Faiyaz. Following media reports, a writ petition was filed in the High Court.
On Sunday afternoon, lawyer Shahdeen Malik presented the writ before the High Court bench of Justice Mohammad Khurshid Alam Sarkar and Justice Md. Moniruzzaman. During the hearing, Additional Attorney General Sheikh Mohammad Morshed informed the court that the child would not be taken on remand and that his family could apply for bail in court, which would be considered under child law.
The High Court expressed concerns over the Magistrate’s failure to consider the boy’s age, as his father had shown all documents proving that Faiyaz was 17 years old. The High Court urged immediate action and deferred the matter to the next day for further hearing.
According to his birth certificate, Hasnatul Islam Faiyaz was born on April 19, 2007. He achieved a Golden A+ in the SSC exams from Shamsul Haque Khan School and College, Dhaka, in 2024. Currently a first-year student at Dhaka College, he was presented in court on Saturday (July 27). The case document listed his age as 19 years. His family reported that plainclothes officers took Faiyaz from their Matuail residence on the night of July 24 for questioning.
Faiyaz’s lawyer, Ishtiaq Hossain, told the media that Faiyaz’s age was 17 years, 3 months, and 8 days, according to his birth certificate and SSC certificate. Despite their appeal to transfer the case to a juvenile court, the Magistrate granted a 7-day remand.
